    Content use

    The user declares to fully accept all the General Terms and Conditions of using the Aquastanding website. If the user does not understand or does not intend to comply with any of these terms, they shall neither access nor use the Aquastanding website and/or the content made available through the same.

    The user agrees to make legal, diligent, honest and appropriate use of any information or content made available to them through the Aquastanding website. The user may not reproduce, transmit or exploit the content of this website, without prior authorisation from Aquastanding.

    These General Terms and Conditions, the General Conditions of Contract outlined in Title III and/or any specific terms that, if required, may be included, can be amended at any time and with no prior notification. Aquastanding shall publish these amendments on the website to ensure users are always fully informed of the same before using the site or purchasing any product sold thereon.

    Aquastanding aims to ensure that the content of this site is accurate and regularly updated, but accepts no liability with regards to this content. Aquastanding does not guarantee the veracity, reliability or exactness of its content.

    Aquastanding will under no circumstances be held liable for any damage caused to third parties by users of this website as a result of illegal or inappropriate use of the same, nor as a result of the content and information accessible through or provided by the site or by any of the sites linked to the same. Any users or third parties responsible for causing such damage shall be held liable for the same. Any potential reference made on this website to any product, service, process, link, hypertext or any other information using the logo, trading name or name of the third party manufacturer or supplier, neither constitutes nor implies support, sponsorship or recommendation on behalf of Aquastanding.

    These general terms and conditions are subject to Spanish legislation, which shall be applied in relation to the validity, interpretation, implementation and fulfilment of these terms.

    TITLE III: "TERMS REGULATING THE COMMERCIAL RELATIONSHIP ESTABLISHED BETWEEN AQUASTANDING AND THE USER”

    GENERAL CONDITIONS OF CONTRACT

    Preconditions

    These General Conditions of Contract, together with any specific terms which may be applied, govern the relationships to arise between L' Alqueria Projectes SLU and third parties using the Aquastanding website, as well as with users who purchase the products offered by the same.

    These General Conditions of Contract comply with the following regulations:

     Law 34/2002 regarding Information Society Services and Electronic Trading.

    Law 7/1998, dated 13 April, regarding General Conditions of Contract.

    Law 7/1996 regarding Retail Trading.

    Law 47/2002, dated 19 December, amending Law 7/1996, dated 15 January, regarding Retail Trading, for the transposition to Spanish law of the 97/7/CE Directive governing long-distance contracts and for the adaptation of this Law to various EU Directives.

     Royal Decree 1906/1999, dated 17 December, regulating telephone or online contracts.

    Law 23/2003, dated 10 July, regarding Guarantees in the Sale of Consumer Goods.

    These General Conditions of Contract can be amended and/or updated with no prior, express notification. Therefore, we advise users to always carefully read these conditions before accessing the Aquastanding site.

    L' Alqueria Projectes SLU reserves the right to amend and/or update the presentation and configuration of the Aquastanding website with no prior notification.

    Both third parties accessing the Aquastanding site and/or purchasing the products presented thereon, shall be considered as a USER, thereby implying full acceptance of these General Conditions of Contract.

    Aquastanding General Terms and Conditions of Sale

    These general terms and conditions of sale govern the commercial relationship between Aquastanding and any user to purchase any product presented by Aquastanding, hereinafter the CUSTOMER.

     PRICES

    The prices listed on the Aquastanding site include VAT and can be modified with no prior notification. Both the RRP (Recommended Retail Price) and the prices offered by Aquastanding are published.

    Delivery times:

    All products in our catalog are not available in stock. We manage daily orders and delivery time depends on the availability of each item. In each of the products displayed in the catalog indicates the approximate delivery time, this data are informative and indicates the usual delivery time for each item.

    We strive for the periods indicated are met. But, sometimes, the delivery times can be altered by other factors: the availability of the factory, the speed of delivery for transportation agencies,... 

    These are the various deadlines that lie between the items from our catalog:

    •        Delivery within 1 to 3 days
    •        Delivery within 3 to 4 days
    •        Delivery within 5 or 6 days
    •        Delivery within 8 to 10 days
    • ·       Delivery within 10 to 12 days
    • ·       Delivery within 12 to 15 days
    •        Delivery within 15 to 20 days

    The logo "Star" on the delivery times means that the product is classified as "special order" and does not accept cash on delivery. Delivery times can vary so it is recommended to request the delivery time before purchase.

    Delivery times given are always expressed in working days and report the usual delivery time for each product.

    When ordering multiple products, if any item is not available: The customer can choose to receive your order in a single shipment and wait for the availability of all products. Or choose two shipments. In this case, we deliver first the items available and in a second shipment the rest of the order. These orders two shipments, are treated as separate for the purposes of shipping.

    Delivery times specified in the catalog are for shipments to Spain and Portugal. You must have 2 or 3 days more to ship to France and 3 to 5 days for shipping to other countries of Europe.



     DELIVERY METHODS AND SHIPPING COSTS

    We offer door-to-door delivery. To guarantee the speed and security of our deliveries, all shipments are carried out by transport agencies.

    Delivery of heavy or pallet-stacked goods are made to street level, the couriers are not obliged to transport these goods up to or around the home.

    Place and method of delivery: Orders shall be delivered to the address given by the customer when placing their order. It is not possible to subsequently change the place of delivery, therefore customers must ensure the correct address is given when placing their order.

    The goods shall be delivered to the customer by a courier, together with a delivery note containing the necessary information to identify the customer, the order, the total amount to pay (for cash on delivery orders only ) and the number of parcels to deliver.

    The goods shall be covered at all times by an insurance policy against transport-related risks, loss and mishandling during transport.

    Orders shall be delivered by MRW (mainland Spain only) or SEUR. Both agencies offer a 24 hour service for deliveries in mainland Spain. SEUR offers a 24/48 hour service for deliveries to the Balearic Islands and Portugal, a 48/72 hour service for deliveries to France and a 3 to 5 day service for deliveries to all other EU countries. Unless there are any delays on behalf of the courier, the customer shall receive their order within the indicated delivery time from receiving confirmation that the order has been dispatched.

    Each of these delivery methods entails shipping costs that are payable by the customer. These costs appear when the customer updates their order and are included in the total order amount.

    A telephone number must be provided for the person who shall receive the parcel.

    Once the order has been handed over to the agency, the customer shall be notified by email to expect delivery of their goods. In addition, the issue number and the name of the agency will be provided so the customer may track their order online and keep up to date will the status of their order at all times.

    If the customer is not at the delivery address when the delivery is made, the courier shall leave a note for them to contact the delivery service. In this event, any additional costs are payable by the customer.

     PAYMENT METHODS

    We accept the following methods of payment:

     Cash on delivery: This method of payment is only visible for nationally registered customers. It’s only suitable for domestic shipments within Spain on the peninsula. For us to process an order with this payment method, the delivery costs must be paid in advance by bank transfer to the Caixa Popular account  ES49 3159 0043 0323 2143 3225, account holder L’Alqueria Projectes, SLU, stating the full name of the person who placed the order and the order no.

    If there are no delivery charges for the order due to the free delivery promotion, the customer must make an advance payment via bank transfer equal to the amount in the field "Surcharge for payment method”. Customers opting for this method of payment shall incur a 6% increase on the total price of their order to cover processing costs. When receiving the order, the exact outstanding amount must be given to the courier since they do not carry change. If, for this reason, the amount due is not paid, the courier will be forced to make another delivery with the customer baring the cost of the same. This method of payment is not accepted for "special order” or "free delivery” items. 
    The items in our catalog that "NOT accepted" this form of payment are identified with a blue star.


     VISA and MASTERCARD payments: We recommend this method as the easiest and safest option and because there is no additional charge for processing the payment. Payment is only accepted through the secure card system. Card payments are taken through TPV Virtual, which complies with the secure electronic trading regulations adopted by the international companies VISA and MASTERCARD. This new card payment system verifies the identity of the purchaser and ensures secure on-line sales. There are three steps involved in the secure trading system:  

    Firstly, the customer must enter their card number and expiry date. 

    Then, the corresponding card company verifies the identity of the customer either by an automatic call to their mobile, requesting a password or by any other security method chosen by the issuing entity. 

    The secure transaction will only be completed if the customer is positively identified. This helps to prevent undesirable cases of fraud due to theft or loss of cards.

Please note that this method of payment may delay delivery times since the order will not be dispatched until the transfer is received.

     INCIDENTS AND RETURNS

    In accordance with the provisions of the Retail Trading Law, the customer reserves the right to return any product within 14 days from receipt of the same, providing the original packaging remains intact and the item has not been used. In the event of returning an item due to a change of opinion, the return shipping costs shall be payable by the customer. However, special orders cannot be returned unless the item is faulty.

    In any event, the return of any item requires an agreement between Aquastanding and the customer. The item shall not be refunded or replaced until Aquastanding has confirmed:

    In the event of returns due to a change of opinion; that the original packaging remains intact and the item has not been used.

    In the event of returns due to product faults; the exact nature of the fault.

    In the event of returns because the item received does not correspond to that purchased by the customer; the item reference on the order and its relationship to the item delivered.

    If when receiving their parcel the customer detects any damage, finds the parcel to be in poor condition or is missing a package, this must be recorded on the courier’s delivery note, otherwise Aquastanding shall accept no responsibility for damaged or missing goods. In addition, the customer must inform Aquastanding of the incident within 24 hours. We only accept claims made by completing and sending in the following Incidents, exchanges and returns form. Aquastanding shall respond within 24/48 hours.

    Aquastanding shall refund or replace any item providing that:

    1. The request is made within 24 hours of receiving the goods, which must be returned within the next 14 days and, in the event of returns due to a change of opinion, the return postage has been paid, the item is in perfect condition and its original packaging remains intact.

    2. The product is faulty. Aquastanding shall repair or exchange it for a similar item, depending on the manufacturer''s guarantee, and dispatch it immediately to the customer.

    3. The item delivered does not correspond to that requested by the customer. Aquastanding shall dispatch the correct item.

    Orders may be cancelled providing they have not already been dispatched. Cancellations must be requested by email or telephone. If the customer has already paid for the order, Aquastanding shall issue a refund within 14 days by the same method used to make the payment.

    If the requested item cannot be supplied, Aquastanding shall refund the amount paid by the customer.

    In order to process any return, the following Incidents, exchanges and returns form must be used. Aquastanding shall respond within 24/48 hours.

    Aquastanding shall not accept returns that do not comply with the terms established this section.

     CLAIMS

    We only accept claims made by completing and sending in the following Incidents, exchanges and returns form. Aquastanding shall respond within 24/48 hours.

     GUARANTEES

    All products are supplied with a guarantee. The general terms and conditions of each guarantee are determined for each type of item by the manufacturer of the same. The name of the manufacturer appears on the product label, or in the absence thereof, on any part of its packaging.

    If the item is proven to be faulty, and depending on the manufacturer’s guarantee, Aquastanding shall exchange it for a similar item or send it to the manufacturer to be repaired and then returned to the customer.

    The products supplied by Aquastanding are covered by a manufacturer’s guarantee against any manufacturing fault, according at all times to the specific terms and conditions established by the same. This guarantee shall not apply in the following cases:

    If the product has been handled or repaired outside of the technical services offered by the manufacturer.

    The product is not in its original packaging.

    The item is not accompanied by the corresponding purchase invoice.

     INVOICING

    L' Alqueria Projectes SLU shall issue electronic invoices sent by email to the address given by the customer.

    L' Alqueria Projectes SLU stresses that in accordance with current legislation, purchase invoices cannot be amended after being issued. (Royal Decree 1496/2003 regarding Invoicing regulations, amended by Royal Decree 87/2005). Invoices are issued in the name of the individual or company that placed the order, therefore the customer must be sure to place their order under the correct name. No changes can be make after the order has been confirmed.

    L' Alqueria Projectes SLU stresses that for the protection of personal data, duplicate invoices shall only be issued to the named contract owner. Duplicate invoices shall not be issued to third parties. L' Alqueria Projectes SLU shall only send duplicate invoices to the address given by the named contract owner and never by fax or email. Once the guarantee period has expired, no additional duplicate invoices can be issued.
